The Johnson County District Attorney has announced that criminal charges will not be filed against the officer who fatally shot a man earlier this year. The man had held people hostage at a Shawnee QuikTrip and the decision was made after a thorough investigation into the incident.
On Monday, Steve Howe revealed fresh information about the incidents that took place on February 18. According to Howe, the perpetrator, Brett Smiley, entered a Hardee’s restaurant in Olathe in the nude while carrying a knife. He proceeded to drive to Shawnee and fired gunshots into the air along Kansas Highway 7.
As the video footage reveals, Smiley can be seen brandishing a firearm inside the QuikTrip located at Shawnee Mission Parkway and Woodland Drive. He fired a shot into the ceiling and commanded everyone in the store to get down on the ground.
According to investigators, Smiley was seen pointing the gun in the direction of the responding officers by a group of them.
Fortunately, there were no other casualties in the shooting incident.
According to the DA, Smiley’s family informed him that he faced challenges with substance abuse and mental health.
According to Howe, the family is devastated by the loss of their son, and it demonstrates how substance abuse and mental health issues can have a devastating impact on families.
According to the DA’s Office, the officer who shot Smiley acted in a justifiable manner to protect himself and those around him.
According to Shawnee Police Chief Sam Larson, the response to the situation was executed perfectly, following standard procedures.
