Prosecutors want to hold a California mother and two relatives in jail pending trial for allegedly torturing her 3-year-old daughter to death. According to a lawsuit obtained by CW San Francisco station KRON, Deputy District Attorney Rebekah Wise claims they have not demonstrated remorse. The state claims that the mother, Claudia Hernandez, 26, would endanger the public, particularly children, if released.
The defendant allegedly asserted her belief that a demon possessed the 3-year-old victim, Arely Naomi Proctor. Authorities claim she even bought a burial gown for the youngster before his death.
Hernandez allegedly claimed to have previously received a vision from God, indicating that God was “going to Arely.” He also claimed that two weeks before the girl died, she had a vision of dropping her off at the gates of heaven.
“Claudia stated she thought, ‘All right, baby, you have to go,” the documents reportedly stated.
“She has shown no remorse for the violent assault she committed against Arely, and she does not believe that what she did was wrong,” Wise allegedly wrote.
As the state has done in previous filings, Wise emphasized the horrific and extended nature of Proctor’s death.
“During this assault, Arely Doe fought for her life as the three defendants, all trusted adults, forcibly grabbed her neck, torso, back, and legs and smothered her,” Wise allegedly wrote.
The attack, according to prosecutors, lasted about 20 hours and ended at Iglesia Apostoles y Profetas, which Hernandez’s father and co-defendant, Rene Trigueros Hernandez, 60, then operated.
Hernandez’s 20-year-old brother, Rene “Aaron” Hernandez Santos, faces accusations of involvement as well.
“Around 7:00 p.m., Defendant 2 [the uncle] knelt down beside the victim who was lying on the floor, and he placed one hand on the victim’s chest and one hand on her back,” according to a factual statement. “He applied and sustained pressure on the victim for around ten minutes. He added that the victim was alive at the start of this, and he closed his eyes in prayer. He opened his eyes, believing the victim had perished. They continued to pray but did not take any life-saving measures for the victim.
The charges against all three parents include criminal child abuse that resulted in death.
